Prepared in terms of Section 51 of the Promotion of Access to Information Act (Act 2 of 2000)

1. INTRODUCTION TO THE COMPANY

Tradeway (Pty) Ltd is a company that provides marketing, promotional, and activations services across South Africa. This manual has been prepared in accordance with the Promotion of Access to Information Act 2 of 2000 (PAIA) and also considers the Protection of Personal Information Act 4 of 2013 (POPIA).

3. THE ACT AND OBJECTIVE OF THIS MANUAL

PAIA gives effect to the constitutional right of access to information held by private and public bodies, which is required for the exercise or protection of any rights.

This manual provides guidance to requestors wishing to access records held by Tradeway (Pty) Ltd, and outlines:

  • The structure of the company
  • The types of records held
  • The procedure to request access
  • Applicable fees

4. GUIDE ON HOW TO USE PAIA (SECTION 10)

A guide on how to use PAIA is available from the Information Regulator. It is intended to help individuals understand their rights and obligations under the Act.

5. RECORDS AVAILABLE IN TERMS OF OTHER LEGISLATION

Tradeway complies with applicable South African legislation, including but not limited to:

  • Companies Act, 71 of 2008
  • Income Tax Act, 58 of 1962
  • Value Added Tax Act, 89 of 1991
  • Protection of Personal Information Act, 4 of 2013
  • Basic Conditions of Employment Act, 75 of 1997

7. RECORDS HELD BY TRADEWAY

The company holds the following categories of records, which may be requested if the request meets the requirements under PAIA:

a) Personnel Records

Internal HR records (not publicly accessible)

b) Other personal Information

Limited to contact details captured through the “Contact Us” form on the website:

  • Name
  • Email address
  • Telephone number

These are stored solely for the purpose of responding to enquiries and are not shared or used for any other purpose.

c) Company Records

  • Company registration documents
  • Statutory compliance records
  • Financial statements (internal use)

8. RECORDS SUBJECT TO POPIA

Tradeway respects your right to privacy and only collects the minimum personal information necessary. In terms of POPIA, all contact information captured is:

  • Collected with consent
  • Used only to respond to direct requests
  • Not sold, shared, or transferred without lawful justification
  • Stored securely and deleted once the enquiry has been addressed (unless further processing is required with consent)

9. REQUEST PROCEDURE

To request access to a record, complete the prescribed Form C (available on the Information Regulator’s website or from Tradeway), and submit it to the Information Officer with:

  • Proof of identity
  • Sufficient detail to identify the record(s) requested
  • Reason for the request
  • Payment of the applicable request fee (if required)

10. PRESCRIBED FEES

A requester may be required to pay a request fee (for non-personal records) and an access fee for the time and resources involved in locating and compiling the information.

Details on fees are available in the PAIA Regulations or from the Information Officer upon request.
